Proposed Change

The Town is proposing the following amendments to the Zoning By-law inn order to permit special event tents on a seasonal basis. It is proposed that Section 6.35(i) be amended to:

  • Allow special event tents on a seasonal basis from May 1to October 31each year; and
  • That the number of special events be limited to a maximum of 24 events per calendar year
  • The proposed amendment also includes specific setback requirements

The Town of Lincoln is seeking to amend the Zoning By-law to permit seasonal tents.  Currently, special event tents are not permitted to be erected for an entire season by the Town’s Zoning By-law.  

Section 6.38(f) of the Zoning By-law prohibits the use of tents for business or other purposes.  Special event tents are only permitted as a temporary use in accordance with Section 6.35(i) of the Zoning By-law.  Section 6.35(i) permits the use of a tent for special events for not more than three consecutive days.  As a result, building permits may only be issued for the use of a tent for up to three days and at the end of the three-day period the tent must be removed.

The initiation of this Zoning By-law Amendment will assist in streamlining the tent permitting process for the local tourism industry.

Section 34 of the Planning Act Legal Notice Requirements 

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town before the proposed Zoning By-law Amendment is adopted, the person or public body is not entitled to appeal the decision of the Town to the Local Planning Appeal Tribunal.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town before the proposed Zoning By-law Amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal Board, unless in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

If you wish to be notified of the adoption of the proposed Zoning By-law Amendment, you must make a written request to the Clerk of the Town and such request must include the name and address to which such notice should be sent.
